The pengespilloven is Lov om pengespill (LOV-2022-03-18-12), in force 1 January 2023, read with pengespillforskriften. § 10 and § 11 grant Norsk Tipping the exclusive right to online casino games, bet and lottery in Norway; § 14 grants Stiftelsen Norsk Rikstoto the exclusive right to offer pengespill on hest. Offering pengespill to Norwegian players without one of those permits is forbidden under § 4, facilitating payments to such an operator is forbidden under § 5, and marketing pengespill to Norwegian players without a permit is forbidden under § 6. The age limit is 18, and gambling on credit is forbidden, under § 7.

The grunnprinsipp is the virkemåte, the operating mechanism, of the Norwegian live-roulette market in 2026. The virkemåte has three moving parts. The first is the market-side: a closed market in which the supplier is Norsk Tipping, the supplier faces no other national competitor, and the supplier’s competitive terms are the gevinstandel the supplier publishes per game. The second is the player-side: the player inside Norsk Tipping’s system has a loss limit the operator enforces, an identification the operator performs, a pause and self-exclusion tool the operator runs, and a complaint path through Lottstift. The third is the offshore-side: the offshore operator offers on a foreign licence under foreign terms, the Norwegian player’s bank may decline the charge under the payment-transaction ban, and the Norwegian IP path is, since January 2025, increasingly closed by the DNS-block list Lottstift maintains under § 32 a.

The cost of staying inside, and the cost of stepping out

A Norwegian player who steps outside Norsk Tipping onto an offshore site faces the same wheel on a Curaçao or Anjouan licence, but the onside limit is gone — the operator does not enforce a monthly loss ceiling because there is no Norwegian statute to enforce — and the player is on the outside of the protection scheme without Norwegian supervision. The price the player pays for stepping outside is the loss of the Norwegian operation’s loss limit, the loss of the Norwegian operation’s supervision, and the appearance of a charge on the bank statement the player may, under skatteloven § 5-50, owe tax on above 10 000 kr.

A Norwegian live-roulette search turns up two app-shaped answers. The first is Norsk Tipping’s mobile app, which carries the same KongKasino catalogue the desktop site does, the same loss limit, the same identification and the same gevinstandel. The Norwegian app is the same product as the Norwegian desktop site; the offshore app is the same product as the offshore desktop site. Who has the right

Norsk Tipping AS holds the enerett to online casino, betting and lotteries in Norway. The company is state-owned, runs the Instaspill portfolio the operator launched on 14 January 2014, and is supervised by Lottstift. Stiftelsen Norsk Rikstoto holds the enerett to horse betting in Norway, is supervised by Lottstift, and offers no casino games.

The grunnprinsipp that follows from those two grants is simple. Norsk Tipping’s enerett covers everything inside the pengespill catalogue that is not horse betting; Norsk Rikstoto’s enerett covers everything inside the horse-betting catalogue. Anything that is online casino or live roulette sits inside Norsk Tipping’s enerett; anything that is horse betting sits inside Norsk Rikstoto’s enerett; anything that is online casino or live roulette and is offered by an operator other than Norsk Tipping is offered without permission under § 3–7 of the pengespilloven.

The legal tools against the operators on the wrong side

Lottstift has three tools against an unlicensed operator, and the three tools stack. § 4 forbids the offer. § 5 forbids the facilitation of payments to the operator. § 6 forbids the marketing of pengespill to Norwegian consumers by the operator. § 32 a, in force 1 January 2025, adds the DNS-block tool; the first DNS-block decisions were issued on 24 March 2025, and Lottstift has since blocked 238 sites across 72 companies. The three tools do not punish the player. The player on an offshore site has not committed an offence under the pengespilloven; the player on an offshore site has lost the protection the pengespilloven gives the player who stays inside.

The tax on an offshore win

The Norwegian tax frame adds a layer. Winnings from Norsk Tipping and Norsk Rikstoto are tax-free whatever the amount. Winnings from a commercial foreign-gaming operator are, as a rule, taxable above 10 000 kr under skatteloven § 5-50, and an EEA licence does NOT make the winning tax-free. A Norwegian player who lands a single offshore win above 10 000 kr owes the engine to table the prize on its own tax return; the prize is the prize the operator paid, but the prize is now also a taxable receipt. The Norwegian player who plays inside Norsk Tipping never has to. The Norwegian player who plays inside Norsk Tipping will never have to.
